Please read these Terms of Use ("Terms") carefully before using www.crystalwright.com (the "Site") operated by Motivational Media Productions, LLC ("Company," "us," "we," or "our"). We reserve the right to refuse or cancel any order at any time for reasons including product availability, pricing errors, errors in your order, suspected fraud, or unauthorized or illegal transactions.

All User Contributions must comply with all applicable federal, state, local, and international laws and regulations. User Contributions must not:

  • Contain material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.
  • Promote sexually explicit material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
  • Infringe any patent, trademark, trade secret, copyright, or other intellectual property rights of any person.
  • Violate the legal rights of others, including rights of publicity and privacy, or give rise to civil or criminal liability.
  • Be likely to deceive any person.
  • Promote any illegal activity or assist any unlawful act.
  • Cause annoyance, inconvenience, or needless anxiety, or be likely to upset, embarrass, alarm, or annoy any other person.
  • Impersonate any person or misrepresent your identity or affiliation with any person or organization.
  • Involve unauthorized commercial activities such as contests, sweepstakes, promotions, barter, or advertising.
  • Create the impression of endorsement by the Company if no such endorsement exists.

7. Intellectual Property

The Site and its entire content, features, and functionality — including all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof — are and will remain the exclusive property of Motivational Media Productions, LLC, its licensors, or other content providers, and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

These Terms permit you to use the Site for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, perform, republish, download, store, or transmit any material from the Site without our prior written consent.

The Crystal Wright name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Motivational Media Productions, LLC. You may not use these marks without our prior written permission. All other trademarks on this Site belong to their respective owners.

8. Prohibited Uses

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

  • In any way that violates any applicable federal, state, local, or international law or regulation.
  • To exploit, harm, or attempt to exploit or harm minors in any way.
  • To transmit unsolicited advertising or promotional material, including spam or chain letters, without our prior written consent.

  • Terminate or suspend your access to all or part of the Site for any violation of these Terms.

We will cooperate fully with any law enforcement authorities or court orders requesting disclosure of information about anyone posting materials on or through the Site. YOU WAIVE AND HOLD HARMLESS THE COMPANY AND ITS AFFILIATES FROM ANY CLAIMS RESULTING FROM ACTIONS TAKEN BY THE COMPANY OR LAW ENFORCEMENT IN CONNECTION WITH ANY SUCH INVESTIGATION.

We do not undertake to review all material before it is posted on the Site and assume no liability for any action or inaction regarding user-submitted content.

TO THE FULLEST EXTENT PROVIDED BY LAW, WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES, OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR COMPUTER EQUIPMENT, PROGRAMS, DATA, OR OTHER PROPERTY DUE TO YOUR USE OF THE SITE OR ANY MATERIAL DOWNLOADED FROM IT.

YOUR USE OF THE SITE, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE IS AT YOUR OWN RISK. MOTIVATIONAL MEDIA PRODUCTIONS, LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE.

12. Limitation of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL THE COLLECTIVE LIABILITY OF MOTIVATIONAL MEDIA PRODUCTIONS, LLC, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS EXCEED THE GREATER OF $2,500 OR THE AMOUNT YOU HAVE PAID TO MOTIVATIONAL MEDIA PRODUCTIONS, LLC IN THE 12 MONTHS PRECEDING THE CLAIM.

This limitation does not apply to liability resulting from our gross negligence or willful misconduct, or death or bodily injury caused by products purchased through the Site.

13. Indemnification

You agree to defend, indemnify, and hold harmless Motivational Media Productions, LLC, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site, including any unauthorized use of the Site's content, services, or products.

14. Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages. The limitations above may not apply to you in those jurisdictions.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or related to these Terms or the Site shall be brought exclusively in the federal or state courts located in King County, Washington, although we retain the right to bring any action against you in your country of residence or any other relevant jurisdiction. You waive any objection to the exercise of jurisdiction by such courts.

Our failure to enforce any right or provision of these Terms will not constitute a waiver of those rights. If any provision is held invalid or unenforceable, the remaining provisions will remain in full effect. These Terms constitute the entire agreement between us regarding the Site and supersede all prior agreements.

16. Arbitration

At the Company's sole discretion, it may require you to submit any disputes arising from these Terms or use of the Site — including disputes regarding their interpretation, violation, invalidity, non-performance, or termination — to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association, applying Washington State law.

17. Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

18. Entire Agreement

These Terms constitute the sole and entire agreement between you and Motivational Media Productions, LLC regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
